IRS Extends Reporting Deadlines for 2015 ACA Information Reporting Forms

To help alleviate concerns about reporting readiness voiced by groups representing employers, payroll service providers, and health insurers, on December 28, the IRS announced extensions to the filing deadlines for the following 2015 Affordable Care Act (ACA) information reporting forms:

 

      • Form 1095-B, furnished to insured individuals by March 31, 2016 (from February 1, 2016); and filed with the IRS by May 31 or June 30 if filing electronically (from February 29 and March 31, respectively);

 

      • Form 1094-B, filed with the IRS by May 31 or June 30 if filing electronically (from February 29 and March 31, respectively);

 

      • Form 1095-C, furnished to employees by March 31, 2016 (from February 1, 2016) and filed with the IRS by May 31 or June 30 if filing electronically (from February 29 and March 31, respectively); and

 

      • Form 1094-C, filed with the IRS by May 31 or June 30 if filing electronically (from February 29 and March 31, respectively) [Notice 2016-04, 12-28-15; https://www.irs.gov/pub/irs-drop/n-16-04.pdf].

 

Permissive and automatic extensions not applicable

Because of the extensions granted in Notice 2016-04, the provisions regarding how to request automatic and permissive extensions of time for filing information returns and permissive extensions of time for furnishing statements will not apply to the extended due dates.

 

Guidance for individuals

The IRS is aware that, due to the extended deadline to report health care information, individual taxpayers may not receive Forms 1095-B or 1095-C by the time they file their 2015 tax returns. Notice 2016-04 provides additional guidance for those taxpayers that generally allows them to use information on hand at the time of filing without the need to amend the return or send the health care information to the IRS once it is available. However, the IRS advises taxpayers to retain the information with their tax records.
